Bloomsights Terms of Use

1. Acceptance of Terms

By accessing or using the Bloomsights platform (“Services”), you agree to these Terms of Use and our Privacy Policy. If you do not agree, do not use the Services.

2. Eligibility and School Use

Bloomsights is provided to schools, districts, and educational institutions. Students access the Services only under the direction of their school or district. By using the Services, you confirm you are authorized to act on behalf of your institution.

3. Privacy and Student Data

Your use of the Services is also governed by our Privacy Policy. Bloomsights operates as a school service provider and processes student information only as authorized by schools and districts.

Bloomsights does not collect parental consent directly. Schools and districts are responsible for obtaining any required parental or guardian consents and providing any required notices under COPPA, FERPA, and applicable state laws when using the Services for educational purposes.

4. User Responsibilities

Use the Services only for lawful educational purposes and consistent with school policies.
Provide accurate roster information and keep it updated.
Keep accounts secure, including managing staff access and protecting passwords and single sign on credentials.

5. Data Security and Retention

We maintain administrative, technical, and physical safeguards to protect data. Student responses are retained for two years unless otherwise agreed in writing with the school or district. Additional details are described in the Privacy Policy.

6. Intellectual Property

The Services and all related content are owned by Bloomsights US, LLC and its licensors. We grant schools a limited, non-exclusive, non-transferable license to use the Services for educational purposes. You may not copy, modify, reverse engineer, or create derivative works without written permission.

7. Prohibited Uses

Attempting to gain unauthorized access to the Services or data.
Using the Services for advertising or other commercial purposes outside educational use.
Interfering with or disrupting the Services.

8. Service Availability

We strive to provide reliable Services but do not guarantee uninterrupted or error-free operation. We may suspend or change features to protect security or maintain the Services.

9. Disclaimers and Limitation of Liability

The Services are provided “as is” and “as available.” To the fullest extent permitted by law, Bloomsights is not liable for indirect, incidental, special, consequential, or punitive damages. Our total liability related to the Services will not exceed the fees paid to Bloomsights by the school or district for the twelve months before the claim.

10. Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to conflict of law rules.

11. Changes to These Terms

We may update these Terms from time to time. The effective date above will reflect the current version. Continued use of the Services means you accept the updated Terms.
